If he had received a conditional discharge, he would’ve had to meet certain requirements, like keeping a job or paying fines. But with this unconditional discharge, he’s off the hook for all that, according to The New York Times.
He was found guilty of 34 counts of falsifying business records, all to cover up an affair with an adult actress. At one point, he was facing up to four years in prison or probation, but the judge decided to go easy on him.
Justice Merchan had a lot to think about when it came to sentencing. Unconditional discharge means no jail time, fines, or probation. The law says it’s used when the judge believes that imposing conditions wouldn’t serve any real purpose.
This decision seems to be Merchan’s way of wrapping things up without messing with Trump’s presidency. Trump even appeared virtually in court during the sentencing, which is a bit wild.
Now, is this kind of sentence common? Not really. Since 2014, a third of defendants in similar cases got less than a year in jail, but no one else got an unconditional discharge like Trump did.
Falsifying business records is considered a low-level felony in New York, so it doesn’t always lead to jail time. Other cases with unconditional discharges involved various offenses, from tax issues to driving under the influence.
In his decision, Merchan mentioned that he thought an unconditional discharge was the best way to bring closure to the case. He made it clear that he was separating Trump the person from Trump the president-elect, emphasizing that the office deserves legal protections.
