David Misch’s bizarre courtroom behavior overshadowed the pain of his victims’ families
Fremont: A 63-year-old serial killer made headlines for all the wrong reasons. David Misch was kicked out of a California courtroom after he started singing “99 Bottles of Beer” during his sentencing for the murders of two young women.
He was found guilty of killing Jennifer Duey, 20, and Michelle Xavier, 18, back in 1986. During his sentencing, he was supposed to hear the impact statements from the victims’ families, but instead, he decided to belt out a tune.
After his outburst, the court had to remove him. Even from a holding cell, he kept whistling the song, which just added to the shock of the situation. The district attorney didn’t hold back, calling his behavior a clear sign of no remorse.
Families of the victims have waited nearly 40 years for justice, and Misch’s antics only added to their pain. The DA praised the jury for holding him accountable after all this time.
During the trial, DNA evidence linked Misch to the crime, found under Duey’s nails. He tried to claim he was a hero who witnessed the kidnapping, but that didn’t hold up in court.
The bodies of the two friends were discovered on the side of the road in Fremont, and they had been brutally attacked. Misch has a history of violence, including a previous murder conviction, and he’s also facing charges for another case involving a young girl.
